Miep Gies, the office secretary who defied the Nazi occupiers to hide Anne Frank and her family for two years and saved the teenager's diary, has died, the Anne Frank House museum said Tuesday. She was 100.

Gies died from a neck injury sustained in a fall at her home shortly before Christmas, museum spokeswoman Annemarie Bekker said.

Gies was the last of the few non-Jews who supplied food, books and good cheer to the secret annex behind the canal warehouse where Anne, her parents, sister and four other Jews hid for 25 months during World War II.

After the apartment was raided by the German police, Gies gathered up Anne's scattered notebooks and papersand locked them in a drawer for her return after the war. The diary, which Frank had been given on her 13th birthday, chronicles her life in hiding from June 12, 1942 until August 1, 1944.

Gies refused to read the papers, saying even a teenager's privacy was sacred. Later, she said if she had read them she would have had to burn them because they incriminated the "helpers."

Frank died of typhus at age 15 in the Bergen-Belsen concentration camp in March 1945, just two weeks before the camp was liberated. Gies gave the diary to Frank's father Otto, the only survivor, who published it in 1947.

"Every day for over two years she put herself in danger by hiding Jews from the Nazis," said Anne Frank's cousin, Bernd "Buddy" Elias, who last saw Gies on her 100th birthday. "If they had caught her, she would have been put in a concentration camp herself."

Her death removed one of the last living direct links to Anne Frank, with only Elias and a few of her childhood friends still alive.

An online registry quickly recorded hundreds of condolences from around the world.

After the diary was published, Gies tirelessly promoted causes of tolerance. She brushed aside the accolades for helping hide the Frank family as more than she deserved -- as if, she said, she had tried to save all the Jews of occupied Holland.

"This is very unfair. So many others have done the same or even far more dangerous work," she wrote in an e-mail to The Associated Press days before her 100th birthday in February.

The Diary of Anne Frank was the first popular book about the Holocaust, and has been read by millions of children and adults around the world in 70 languages.

For her courage, Gies was bestowed with the "Righteous Gentile" title by the Israeli Holocaust museum Yad Vashem. She has also been honored by the German Government, Dutch monarchy and educational institutions.

Nevertheless, Gies resisted being made a character study of heroism for the young.

"I don't want to be considered a hero," she said in a 1997 online chat with schoolchildren.

"Imagine young people would grow up with the feeling that you have to be a hero to do your human duty. I am afraid nobody would ever help other people, because who is a hero? I was not. I was just an ordinary housewife and secretary."

Born Hermine Santrouschitz on Feb. 15, 1909 in Vienna, Gies moved to Amsterdam when she was 11 to escape food shortages in Austria. She lived with a host family who gave her the nickname Miep.

In 1933, Gies took a job as an office assistant in the spice business of Otto Frank. After refusing to join a Nazi organization in 1941, she avoided deportation to Austria by marrying her Dutch boyfriend, Jan Gies.

As the Nazis ramped up their arrests and deportations of Dutch Jews, Otto Frank asked Gies in July 1942 to help hide his family in the annex above the company's canal-side warehouse on Prinsengracht 263 and to bring them food and supplies.

"I answered, 'Yes, of course.' It seemed perfectly natural to me. I could help these people. They were powerless, they didn't know where to turn," she said years later.

Jan and Miep Gies worked with four other employees in the firm to sustain the Franks and four other Jewssharing the annex. Jan secured extra food ration cards from the underground resistance. Miep cycled around the city, alternating grocers to ward off suspicions from this highly dangerous activity.

In her e-mail to the AP in February, Gies remembered her husband, who died in 1993, as one of Holland's unsung war heroes. "He was a resistance man who said nothing but did a lot. During the war he refused to say anything about his work, only that he might not come back one night. People like him existed in thousands but were never heard," she wrote.

Touched by Anne Frank's precocious intelligence and loneliness, Miep also brought her books and newspapers while remembering everybody's birthdays and special days with gifts.

"It seems as if we are never far from Miep's thoughts," Frank wrote.

In her own book, "Anne Frank Remembered," Gies recalled being in the office when the German police, acting on a tip that historians have failed to trace, raided the hide-out in August 1944.

A policeman opened the door to the main office and pointed a revolver at the three employees, telling them to sit quietly. "Bep, we've had it," Gies whispered to Bep Voskuijl.

After the arrests, she went to the police station to offer a bribe for the Franks' release, but it was too late. On Aug. 8, they were sent to Westerbork, a concentration camp in eastern Holland from where they were later packed into cattle cars and deported to Auschwitz. A few months later, Anne and her sister Margot were transported to Bergen-Belsen.

Two of the helpers, Victor Kugler and Johannes Kleiman, were sent to labor camps, but survived the war.

Around 140,000 Jews lived in the Netherlands before the 1940-45 Nazi occupation. Of those, 107,000 were deported to Germany and only 5,200 survived. Some 24,000 Jews went into hiding, of which 8,000 were hunted down or turned in.

After the war, Otto Frank returned to Amsterdam and lived with the Gies family until he remarried in 1952. Miep worked for him as he compiled the diary, then devoted herself to talking about the diary and answering piles of letters with questions from around the world.

After Otto Frank's death in 1980, Gies continued to campaign against Holocaust-deniers and to refute allegations that the diary was a forgery.

She suffered a stroke in 1997 which slightly affected her speech, but she remained generally in good health and mentally alert.

Her son Paul Gies said last year she was still receiving "a sizable amount of mail" which she handled with the help of a family friend. She spent her days at the apartment where she lived since 2000 in the northern town of Hoorn reading two daily newspapers and following television news and talk shows. She recently moved to a nursing facility, before the fall at her home.

She is survived by her son and three grandchildren.

"The Mambo King." Prado grew up in Cuba and worked with casino orchestras in Havana for most of the 1940s. In 1948, he moved to Mexico to form his own band and record for RCA. He quickly specialized in mambos, an upbeat adaptation of the Cuban rhumba. Prado's mambos stood out among the competition, with their fiery brass riffs and strong sax counterpoints, and most of all, Prado's trademark grunts. In 1950, arranger Sonny Burke heard "Que Rico Mambo" while on vacation in Mexico and recorded in back in the U.S. as "Mambo Jambo." The single was a hit and Prado decided to profit himself from the success and tour the U.S. His appearances in 1951 were sell-outs and he began recording U.S. releases for RCA.

In 1954, a number of novelty mambos, including "Papa Loves to Mambo" were recorded by mainstream artists, spurring a wave of mambo dancing and recording. Prado was clearly the leader in this movement, but his greatest success came a year later. He recorded a French song he had first covered in 1951 on the soundtrack of the movie, "Underwater," and when it attracted some attention, RCA released it as a single. "Cherry Pink and Apple Blossom White" reached #1 in the Top 40 charts and held the spot for 10 weeks. He followed this with Top 20 singles of "Anna" and "Skokiaan," but fell out of the charts for the next two years, although his albums continued to sell well.

For all his cheerful demeanor on stage, Prado was a ruthless taskmaster as a bandleader. Trombonist Milt Bernhart recalled an incident during the recording of "Voodoo Suite," a collaboration with arranger Shorty Rogers: One of the movements involved a supposed street-fight in Havana - Carlos Vidal (conga drums) and another Cuban percussionist were to play the roles of the two participants in the rumble. After running the music down once or twice, one of them decided to really get into the spirit of the thing - he stripped down to his shorts! Now, we began to record it. In the middle of their chanting and howling, they forgot where they were and really started to grapple. They were mad and they were wrestling. Half the band fell completely apart. The "take" stopped cold, and I fell on the floor convulsed. Prado seemed to be offended by our laughter and was glaring at me - and possibly Maynard Ferguson - we were in hysterics! The trombone player next to me, who was a regular Prado member, sat staring straight ahead, he didn't get it or he was afraid of Prado's anger. I learned later that Prado fired him - he hadn't done anything.

In 1958, his own song, "Patricia," reached #1, and was later featured in the "scandalous" strip scene in Fellini's film, "La Dolce Vita." His last big hits in the early 1960s were "Guaglione" and "Patricia Twist."

After 1963, RCA stopped releasing Prado in the U.S. market. He returned to Mexico and continued to record and perform in Latin American countries until he retired in the early 1970s. Prado's brother, Panteleon Perez Prado, who moved to Europe in 1956, also ran a mambo band and was so infuriated with his younger brother's success that he even tried to sue in court to be declared as the superior bandleader.

In legal terms, a plea is simply an answer to a claim made by someone in a civil or criminal case under common law using theadversary system. Colloquially, a plea has come to mean the assertion by a criminal defendant at arraignment, or otherwise in response to a criminal charge, whether that person pleaded Guilty, Not Guilty, No Contest or Alford plea.

The concept of the plea is one of the major differences between criminal procedure under common law and procedure under thecivil law system. Under common law, a plea of guilty by the defendant waives trial of the charged offences and the defendant may be sentenced immediately. This produces a system under American law known as plea bargaining.

In civil law jurisdictions, there is generally no concept of a plea of guilty. A confession by the defendant is treated like any other piece of evidence, and a full confession does not prevent a full trial from occurring or relieve the plaintiff(s) from its duty of presenting a case to the trial court.

Peremptory pleas

These are pleas which claim that a case cannot proceed for some reason. They are so called because, rather than being an answer to the question of guilt or innocence, they are a claim that the matter of guilt or innocence should not be considered.

They are :

autrefois convict - where the defendant has already been convicted of the charge (and thus cannot be tried again)
autrefois acquit - where he has previously acquitted of the same charge (and hence cannot be tried again, under the doctrine of double jeopardy),
plea of pardon - where he has been pardoned for the offence.

United States

A defendant who enters a plea of guilty must do so, in the phraseology of a 1938 Supreme Court case, Johnson v. Zerbst, "knowingly, voluntarily and intelligently". The burden is on the prosecution to prove that all waivers of the defendant's rights complied with due process standards. Accordingly, in cases of all but the most minor offences, the court or the prosecution (depending upon local custom and the presiding judge's preference) will engage in a plea colloquy wherein they ask the defendant a series of rote questions about the defendant's knowledge of his rights and the voluntariness of the plea. Typically the hearing on the guilty plea is transcribed by a court reporter and the transcript is made a part of the permanent record of the case in order to preserve the conviction's validity from being challenged at some future time.

Other special pleas used in criminal cases include the plea of mental incompetence, challenging the jurisdiction of the court over the defendant's person, the plea in bar, attacking the jurisdiction of the court over the crime charged, and the plea in abatement, which is used to address procedural errors in bringing the charges against the defendant, not apparent on the "face" of the indictment or other charging instrument. Special pleas in federal criminal cases have been abolished, and defences formerly raised by special plea are now raised by motion to dismiss.

In United States v. Binion, malingering or feigning illness during a competency evaluation was held to be obstruction of justice and led to an enhanced sentence. Although the defendant had pleaded guilty, he was not awarded a reduction in sentence because the feigned illness was considered to mean that he was not accepting responsibility for his illegal behavior.^[1]

English law

Under English law, there is an additional peremptory plea, that of special liability to repair a road or bridge. Under English law, local government authorities have the legal obligation to repair roads or bridges; but, in certain circumstances, the responsibility lies with a landowner instead. The local government authority, charged with a failure to repair a road or bridge, can allege that the responsibility lies with a landowner; at which point, the proceedings against them will be suspended, and proceedings commenced against the landowner they allege to have the responsibility; but if the landowner is found not to be responsible, then the matter may be recommenced against the local government authority. (see R. v. Sutton, Court of King's Bench, 1833)

Estelle Fanta Swaray (born 18 January 1980^[1]^[2]) commonly known asEstelle, and formerly as Est'elle, is a Grammy Award-winning British R&B singer-songwriter, and producer. She also has received the MOBO for 'Best Newcomer'^[3] and received three consecutive 'Best Female Artist' trophies from the UK Hip-Hop Awards.

Career

2004-2007: The 18th Day

In 2004 she broke into the charts with "1980" and "Free" and won a MOBO Award for Best Newcomer. Both of the videos were directed by Andy Hylton ^[4] and received much airplay on music channels. "Free" was written by Estelle and produced by Jimmy Hogarth. Her first album,The 18th Day charted at number 35 in the UK Albums Chart.^[5] Estelle teamed up with short lived pop band 3SL for their single Touch Me Tease Me.

2008-2009: Shine and breakthrough

In 2008, Estelle rose to fame with her collaboration with rapper Kanye West, titled "American Boy". This song reached the top 10 in many countries worldwide, including the United States and Canada, as well as achieving number-one status on the UK Singles Chart^[5]^[6] and in Belgium^[7] and Israel. The song won a Grammy Award for Best Rap/Song Collaboration, as well as being nominated for Song of the Year and many other awards worldwide. "American Boy" was Number 7 on Rolling Stone's list of the 100 Best Songs of 2008.^[8] Shine was released following the single on John Legend's HomeSchool label, reaching the albums chart in most countries worldwide, including number 6 in the UK.^[5] Shine sold enough copies to be certified gold by the British Phonographic Industry, and was shortlisted for the prestigious 2008 Mercury Music Prize. Estelle has also released a new single with American rapper Busta Rhymes called "World Go Round", from his "Back on My B.S.", which was released on 19 May 2009.

2009-present: Upcoming new album

In 2009, Estelle started working on her upcoming third studio album. Rumors suggested Ne-Yo, Missy Elliott, Jay-Z, Lil Wayne,Keri Hilson, T-Pain, Lady Gaga, Mary J. Blige, and Trey Songz, among others, would be working on the album. Production is in the works with The-Dream, RedOne, Polow da Don, Will.I.Am, as well as American singer-songwriter Ne-Yo. On 21 August it was confirmed that Estelle was working with David Guetta on the upcoming album.^[9] Estelle recently made a cameo appearance in the video for new star Mr Hudson for his single "Supernova".

Estelle made an appearance on the 11 August 2009 episode of The Tonight Show with Conan O'Brien. She performed the song "Good Girls Go Bad" with Cobra Starship in Leighton Meester's absence. Estelle also appears on the song "Rollacoasta", co-written by her and American singer-songwriter Robin Thicke, with whom the song appears on his album, "Sex Therapy".
